The Supreme Court granted bail to Lieutenant Colonel Prasad Shrikant Purohit on Monday in the case of Malegaon’s explosion in 2008.
While granting bail, the special court said: “we have set aside the order of the Supreme Court of Bombay.”
The apex court said bail was granted subject to certain conditions.
The conditions will be detailed by the court later.
A court of judges RK Agrawal and AM Sapre said they are putting aside the order of the Bombay Supreme Court for which bail was denied.
Speaking to ANI, former Anti-Terrorism chief (ATS) KP Raghuvanshi said he would comment after a detailed order, but remains to the initial investigation they had carried out.
Earlier, on August 17, Purohit had told the apex court that he had been caught in the “political crossfire” and had languished in jail for nine years.
Colonel Purohit’s sentence of bail was previously rejected by the Bombay Supreme Court, saying that charges against him were of a serious nature, after which he was transferred to the higher court.
Purohit had moved the apex court challenging the order of the high court of Bombay rejecting its bond suit.
A Maharashtra Special Control Court of the organized crime act (MCOCA) had ruled earlier that the ATS had incorrectly applied this law against Sadhvi Pragya Thakur, Purohit, and nine others.
The 4,000-page sheet had alleged that Malegaon was selected as the target of the blast because of a sizeable Muslim population there.
He had named Thakur, Purohit and co-accused, Swami Dayanand Pandey as the key conspirators.
However, Thakur was in 2016 given clean chit by the National Research Agency (NIA).
Sadhvi Pragya has been granted relief in the case by the Bombay Supreme Court.
Seven people were killed in a bomb blast on 29 September 2008 in Malegaon, a community-sensitive textile town in Nashik district, north of Maharashtra.
