The Telangana High Court has made it clear that the direction of the death of the Shadnagar encounter should be settled in the Supreme Court. In the wake of the Supreme Court’s stay on their trial, no decision has been made. The High Court on Thursday (Dec. 12) held an inquiry into the extradition of the bodies of the four accused in the encounter. The High Court said the Supreme Court had set up a commission to inquire into the encounter and imposed a stay on all other proceedings.

The lawyers have asked for clarification on the issue of handing over the bodies of accused persons to the family members. The High Court has directed the Advocate General to consider the issue of handing over the bodies to the family members. The next hearing was postponed to Friday afternoon.
Stay on SIT and NHRC investigations
On Thursday, the second day of the Supreme Court proceedings in the Supreme Court over the encounter of the accused in the direction murder case continued. The Supreme Court has set up a special commission of inquiry with three members to investigate the encounter. Against this backdrop, the Supreme Court stayed the other inquiries into the encounter. It ordered that no further inquiries be held until further orders. This, along with the National Human Rights Commission (NHRC), necessitated the suspension of the High Court and SIT proceedings.
Members of the Trishabhya Commission
The Supreme Court, headed by former Supreme Court judge VS Sirparkar, has appointed the Tribunal Commission of Inquiry. Former Bombay High Court Justice Justice Rekha and former CBI Director Karthikeyan were members of the commission. The Supreme Court has ordered the commission to conduct inquiries in a proper place in Hyderabad. The Telangana government has also ordered that the needs and expenses of the Commission be met. The court said it would be within six months from the date of trial.
No need for Trishabhya Commission: Mukul Rohitgi
Lawyers Mani, Pradeep Kumar Yadav and Mukesh Kumar Sharma have filed petitions in the Supreme Court. The CJI Justice Bobde’s hearing on these petitions was held on the second day. Mukul Rohitgi, Senior Advocate on behalf of Telangana Govt. He also said that there was no need for a Trishabhaya committee inquiry as the SIT investigation was underway.

Mukul Rohitgi said that they were not opposed to the Supreme Court-led inquiry. However, the Supreme Court dismissed his objections. “We don’t mean to say you did wrong, but how does every evidence in the investigation go to the media immediately?” That is why it is necessary to have a transparent investigation.
